2. What processing takes place on the website?

General information on the recipients of data within the Group:

OKS is a globally active company and is part of the Freudenberg Group. Personal data is processed by OKS employees and affiliated companies.

If data is processed in countries outside of the EU, OKS uses EU Standard Contractual Clauses including suitable technical and organisational measures to ensure that your personal data is processed in accordance with the European level of data protection.

Other special recipients are specified in the corresponding processing tasks.

a. Contact form and contact via email
Purpose, legal basis and legitimate interest

The data you enter will be stored for the purpose of individual communication with you. The processing of data entered in one of the contact forms is based on a legitimate interest (Art. 6 Para. 1 f GDPR). We provide contact forms in order to facilitate contact with us. The information you provide will be stored for the purpose of processing your query and any follow-up questions.

If you contact us to enquire about an offer, the information you enter in the contact form will be processed to carry out pre-contractual measures (Art. 6 Para. 1 b GDPR). If you would like your data to be forwarded to our trading partners, it will be processed based on your voluntary consent as specified in Art. 6 (1) (a) GDPR. You are entitled to withdraw your consent with future effect at any time without using a particular form or format.

Storage duration:

Data will be deleted no later than 6 months after your query has been processed.

If a contractual relationship is established, we are subject to the statutory retention periods and will delete your data after 6 or ten years.

b. Use of Friendly Captcha

We use Friendly Captcha on our websites, provided by Friendly Captcha GmbH, Am Anger 3-5, 82237 Woerthsee, Germany.

Friendly Captcha is designed to check whether it is a human or an automated program entering data on our websites, such as details into a contact form. In doing so, Friendly Captcha analyses the website visitor’s behaviour based on different characteristics. The following data is collected during this process:

  • The User-Agent, Origin and Referer request headers
  • The puzzle itself, which contains the information about the account and the site key which the puzzle refers to
  • The widget version
  • A time stamp

Friendly Captcha stores an anonymised counter for each IP address to dynamically adjust the difficulty of the puzzle in the edge network. This identifies malicious users and minimises blocking of genuine users. This data is stored separately from other data and cannot be linked to specific websites. The IP addresses can be anonymised using one-way hashing so that they cannot be identified individually.

The data is processed in accordance with Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in protecting its websites against improper automated access and spam.

c. Website visits
Purpose, legal basis and legitimate interest

When you access our website, in other words, if you do not register or otherwise provide your data, general information is automatically recorded about your visit. This information (server log files) includes, for example, your type of web browser, operating system used, the domain name of your Internet provider, your IP address and similar.

This is processed for the following purposes in particular:

  • To ensure fault-free connection to the website,
  • To ensure smooth use of our website,
  • Evaluation of system security and stability and
  • Further administrative purposes.

We also reserve the right to subsequently check the server log files if there are specific indications of illegal use.

We do not use your data to make any deductions about your person. Information of this type may be statistically evaluated by us in order to optimise our Internet presence and the supporting technology.

Profiling

Tracking tools are used to evaluate the behaviour of website visitors and analyse their interests. To do this, we create a pseudonymous user profile.

f. Use of Matomo
Purpose and legal basis

If you have given your consent, this website uses Matomo, an open-source software for statistical analysis of visitor access. The provider of the Matomo software is InnoCraft Ltd, 150 Willis St, 6011 Wellington, New Zealand.

Matomo sets a cookie (a text file) on your device, with which your browser can be recognized. If subpages of our website are accessed, the following information will be stored:

  • the IP address of the user, shortened by the last two bytes (anonymized)
  • the sub-page visited and the time of the visit
  • the page from which the user accessed our website (referrer)
  • which browser with which plugins, which operating system and which screen resolution is used
  • the time spent on the website
  • the pages that are accessed from the sub-page visited

Matomo is used for the purpose of improving the quality of our website and its content. In this way, we learn how the website is used and can thus constantly optimize our offer.

By anonymizing the IP address by six digits, we take into account the interest of the website visitor in the protection of personal data. The data is not used to personally identify the website user and is not merged with other data. The information generated by the cookie about your use of this website will not be disclosed to third parties

The legal basis for this processing is your consent, Art. 6 para. 1 lit. a DSGVO.

Revocation of consent

You can revoke your consent to the storage and analysis of your data by Matomo at any time via the link below. A so-called opt-out cookie will then be stored on your device, which is valid for two years. As a result, Matomo will not collect any session data. However, please note that the opt-out cookie will be deleted if you delete all cookies.

g. Google AdWords
Purpose and legal basis

Our website uses Google conversion tracking. The operator of Google AdWords is Google LLC, 1600 Amphitheater Parkway, Mountain View, CA 94043, USA. If you reached our website via an advertisement placed by Google, Google AdWords will add a cookie to your computer. The cookie for conversion tracking is added when a user clicks on an advert placed by Google.

If the user visits certain pages of our website and the cookie has not yet expired, we and Google can recognise that someone has clicked on the advert and has thus been redirected to this page. Every Google AdWords customer receives a different cookie. Cookies cannot therefore be tracked via the websites of AdWords customers. The information obtained with the help of the conversion cookie is used to create conversion statistics for AdWords customers who use conversion tracking. This tells the customers the total number of users who have clicked on their ad and were redirected to a website equipped with a conversion tracking tag (so-called generated data). However, they do not receive any information that could identify users personally.

The legal basis for the processing of this data is Art. 6 Para. 1 a of the GDPR.

Recipient:

Every time a user visits our website, personal data, including their IP address, is transferred to Google in the USA. This personal data is stored by Google. Under some circumstances, Google may transfer this personal data collected through the technical process to third parties.

The recipient of the generated data is also the data controller and our service provider www.pulfer.de as processor. We have concluded the corresponding processing contract with the service provider for this.

Our company does not receive any information from Google that could be used to identify the data subjects.

Storage duration:

These cookies expire after 30 days and are not used for personal identification.

Third-party country transfers:

Google processes your data in the USA. We have concluded Standard Contractual Clauses as a suitable guarantee for legally compliant data transfer.

Revocation of consent:

If you do not wish to participate in tracking, you can refuse the setting of a cookie required for this, for example, through a browser setting that disables the automatic setting of cookies or by setting your browser to block cookies from the “googleleadservices.com” domain.

Please note that you must not delete opt-out cookies if you do not want measurement data to be recorded. If you have deleted all of your cookies in the browser, you must re-set the corresponding opt-out cookie.

3. Data security

We only handle personal data to the extent possible in accordance with data protection regulations. We also strive to take all necessary technical and organisational security measures to ensure the adequate protection of your personal data from unauthorised access and misuse at all times.

In order to protect your data during transfer, we use encryption methods (e.g. SSL) via HTTPS. Our servers are secured by means of firewall and virus protection. Back-up and recovery procedures, as well as role and authorisation concepts, are a matter of course for us.

Our employees are obliged to observe the provisions of the GDPR and the Federal Data Protection Act (BDSG).

4. What data protection rights do you have?

Every data subject has the right of information as per Art. 15 GDRP, the right of rectification as per Art. 16 GDPR, the right of deletion as per Art. 17 GDPR, the right of restriction of processing as per Art. 18 GDPR, the right of objection as per Art. 21 GDPR and the right of data portability as per Art. 20 GDPR.

The restrictions pursuant to Sections 34 and 35 of the BDSG apply to the rights of information and deletion.

You may revoke your consent to the processing of personal data at any time. To do this, please contact oks@activemind.de. This also applies to the revocation of consent given before the entry into effect of the General Data Protection Regulation on 25 May 2018. Please note that revocation is only valid with future effect. Processing carried out before said revocation remains unaffected.

5. Changes to our data protection policy

We reserve the right to modify this data protection policy in order to ensure its constant compliance with current legal requirements or to implement changes to our services in the data protection statement, e.g. when introducing new services. The new data protection policy will then apply to your next visit.

6. Information concerning your right of objection pursuant to Art. 21 GDPR

Individual right of objection

For reasons that arise from your particular situation, you have the right to object at any time to the processing of your personal data pursuant to Art. 6 Para. 1 e or f of the GDPR (data processing based on weighing of interests); this also applies to profiling based on this provision within the meaning of Art. 4 no. 4 of the GDPR.

If you object, we will no longer process your personal data unless we can prove compelling, legitimate reasons for the processing that prevail over your interests, rights and freedoms, or the processing is required for the purpose of enforcing, exercising or defending legal claims.
